These terms and conditions are for The Alchemy Institute and our NLP Practitioner six certification on-demand course.
The Alchemy Institute program, run by High Altitude Success LLC is engaged in the business of life coach training services and possesses the skill and qualifications necessary and customary within the field of Life Coach Training, specifically Neuro Linguistic Programming, Hypnotherapy, Emotional Freedom Technique, T.I.M.E. Techniques, and Deep Streaming Facilitation to provide you with the services you are entering in by this agreement.

You are hiring us to provide this training service to you in the form of webinars, audio and/or visual presentations and live coaching and Q & A sessions.

You will also receive unlimited access to all the recorded video and audio material (Training materials) as well as 6 months access to your cohort, Q &A’s and live evaluations to complete your certification.

You have 18 months to complete your certification evaluations in full. After that time period, you can still complete your evaluations with a nominal $350 admin fee.

You understand that we do not guarantee anyone’s specific results. You understand and acknowledge that everyones’ success is different, and dependent on factors, including but not limited to, one’s own drive, dedication and motivation. You further understand and acknowledge that there is inherent risk, as with any venture. Any examples of testimonials from past or current participants in the program are not meant to be a promise or guarantee of your success.

All proprietary, confidential and intellectual property and related materials, including but not limited to The Alchemy Institute course material is the sole property of High Altitute Success LLC under United States Copyright, trademark and other intellectual property laws. You may not use the intellectual property for any purpose other than that contract for you in this agreement, except with written consent of High Altitude Success. You will be responsible for any and all damages resulting from the unauthorized use of the intellectual property.

You shall indemnify and hold High Altitude Success harmless from all claims, losses, expenses, fees, including attorney fees, costs and judgements, that may be asserted against High Altitude Success resulting from or arising out of any negligence or misconduct on your part.

High Altitude Success LLC may terminate this Agreement in its discretion at any time. If High Altitude Success LLC elects to terminate this Agreement with you, it will issue a full refund of the Program Fee to you.

High Altitude Success LLC is not obligated to issue you a refund or return a pro-rata share of the Program Fee to you if you choose to discontinue use of the Program, not participate in the Program, and/or terminate this Agreement.

Except as expressly provided in this Agreement, High Altitude Success makes no guarantees, representations, or warranties of any kind or nature, express or implied with respect to the services negotiated, agreed upon, and rendered. In no event shall High Altitude Success, LLC be liable to you for any indirect, consequential, or special damage. Notwithstanding any damages that you may incur, High Altitude Success entire liability under this agreement and your excluding remedy, shall be limited to the amount actually paid by you to High Altitude Success under this Agreement for services rendered through and including the termination date.

Your rights and obligations under this agreement are personal to you and may not be assigned or transferred to anyone else.

This Agreement shall be governed by and interpreted in all respects in accordance with the laws of the United States of America and the State of Georgia. The venue for any dispute shall be in Gainesville, GA.

If any proceeding or action shall be brought to recover any amount under this Agreement, or for or on account of any breach of, or to enforce or interpret any of the terms, covenants or conditions of this Agreement, the prevailing Party shall be entitled to recover from the other party, as part of the prevailing Party’s costs, reasonable attorneys’ fees, the amount of which shall be fixed by the court or arbitrator and shall be made a part of any award or judgment rendered.
